Welcome! Our Privacy Policy is part of the Epical mobile software application (which we will refer to generally as the “Service” and also sometimes as the “Software”) Terms of Use (the “Terms”), and defined terms in this policy can be found in the Terms. “User,” "you" and  "your" refer to any person accessing the Service or Software, and “ecom enterprises, inc.,” "we," "us," and "our" refer to ecom enterprises, inc., a California corporation, and may also include our affiliates (such as licensors, licensees, suppliers, advertisers, and sponsors) and our officers, directors, employees, consultants, shareholders, agents, and representatives.

We are sensitive to the privacy concerns of our users. Our Privacy Policy explains our practices with respect to the collection, use, and disclosure of personal and non-personal information provided by users. By accessing or using the Service or downloading the Software, including without limitation any free offering, you are consenting to this Privacy Policy.

If you do not agree to any term of this Privacy Policy, please do not access the Service or attempt to register with us.

Notice concerning children

PLEASE NOTE: The Service and Software have a general audience, and we do not direct any of our services or content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children's privacy online. If we learn or have reason to suspect that a user of the Services or Software is under age 13, we will promptly delete any personal information in that user's account and cancel the registration.

Information we collect

Personal information

In general, we only collect personal information from users when they voluntarily submit it to us, generally as part of our registration process that occurs before a user may fully access and use the Service or Software. Personal information that we may collect includes, but is not limited to, first and last name, telephone number, physical address, e-mail address, payment method, credit card number, credit card expiration date, and password.

Our period of retention of credit card information is limited to the time the user remains registered with us.

Please note:  If you choose to download the Software, the Software contains technology which conveys to us and to other persons geolocation data—i.e., where you are physically located at the moment. You can disable this feature if you so desire, but until you do so, your location will be visible to other persons.

We generally retain this geolocation data indefinitely.


Non-personal information

Certain non-personal information about your use of the Service or Software is recorded by the standard operation of the Service and Software. The non-personal information that we collect includes the type of operating system in use (e.g., Macintosh or Windows), the type of browser being used, IP address, and the domain name from which visitors accessed the Service or Software.

In addition, we may collect information about your browsing behavior, such as the date and time you access the Service or the Software, the features of the Service or the Software that you use, the amount of time spent viewing or in use, the number of times you return to the Service or the Software, and other click-stream data (collectively, the "Behavior Information"). We may use cookies (small text files that are stored on users' computers when they access the Service) to collect Behavior Information. We may associate information we collect via cookies with the personal information we collect.

Users are always free to decline cookies, but in doing so they may not be able to use certain features of the Service or the Software. The "help" segment of the toolbar on most browsers explains how to configure a browser to not accept new cookies, how to have the browser inform a user when they receive a new cookie, and how to erase cookies from their hard drives.

Use of information

We may use information collected from users (the "User Information") for any of the following purposes: (i) to facilitate online purchases; (ii) to fulfill orders; (iii) to send marketing and other communications to users; (iv) to conduct internal reviews of the Service or the Software (for example, to determine the number of users of the Service); (v) to help us better understand users’ use of the Service or the Software; (vi) to respond to specific requests from users, such as support services; and (vii) to protect the security or integrity of the Service or the Software and (viii) to track downloads for purposes of paying fees to third parties, if applicable. Non-personal information will be used for purposes of conducting internal reviews of the Service and the Software, monitoring and enforcing our policies, and providing an enhanced online experience for users.


Disclosure of information

We may transfer or otherwise disclose the User Information to (i) Content providers (each a "Provider") and the Provider’s publisher or other distributor (collectively together with Providers, "Content Partners") when the Content is provided by such Content Partners, so that the Content Partners can send users relevant promotional communications about their respective products and services and to (ii) our employees, independent contractors, subsidiaries, consultants, and other business partners and associates, service providers, and suppliers, if the disclosure will enable that party to perform a business, professional, or technical support function for our business operations.

We will not disclose personal information to a third party without your prior permission. We encourage all third parties involved in our business to adhere to this Policy and to manage personally identifiable information in a responsible manner.  However, we cannot and do not assume any responsibility for actions or omissions of third parties, or for their own privacy policies or practices.

We may also disclose User Information if required to do so by law, in response to judicial process, and, as permitted under provisions of law, to provide information to law enforcement agencies or in connection with an investigation on a matter related to public safety. Subject to applicable law, we also reserve the right to release information (i) concerning any user whom we believe is violating his or her obligations to us or engaging in any illegal activity, (ii) to protect the interests of users or others, or (iii) as otherwise permitted or required by law.

Unless expressly allowed under this Privacy Policy, we may only share, transfer or otherwise disclose the User Information to third parties in bulk or aggregate format consisting of anonymous user data, with no personally identifiable information included.

Security of information

We maintain physical, electronic, and procedural safeguards to guard your personal information. We allow access to personal information only to persons and entities engaging in activities provided for by this Privacy Policy. We use industry standard, PCI compliant, data encryption technology, among other technologies, to protect any credit card information you provide us. We use commercially reasonable security measures to guard against the misuse, alteration or loss of personal information. However, no system for transmitting information via the Internet, and no security system, can guarantee complete security. While we seek to diligently protect your personal information, we cannot guarantee the security of our servers. Information you provide us is at your own risk.

Community of users
The Service or the Software may make various kinds of forums available for postings. Any information disclosed in these forums becomes public information. Please carefully consider any proposed disclosure of your personal information.

Unforeseen circumstances

In the event that ecom enterprises, inc. or any of its assets are acquired by a third party, personal information acquired by us may be one of the assets transferred.

Acceptance of Privacy Policy

By accessing the Service or the Software, you agree to the practices described in this Privacy Policy. To the extent that any of the third-party sites accessible through the Service or the Software have privacy practices different from those stated in this Privacy Policy, those third-party privacy practices govern the collection and use of information users provide when visiting those sites. We are not responsible for the policies, content, and practices of other companies.

Changes to this Privacy Policy

On occasion, it may be necessary for us to change the terms of this Privacy Policy. To ensure that users are aware of current privacy practices, we recommend that they check the Service periodically. If you have registered with us, we will send a notice to you at the current email address we have for you on file any time this Privacy Policy is changed.

Deleting or modifying personal information

You may cancel your registration at any time, and you may opt out of receiving any e-mails from us. You may opt out, or modify your personal information, by visiting our website registration page at and following the instructions provided. We encourage you promptly to update your personal information when it changes.
